Resolution approving the State/Municipal Maintenance Agreement Between the City of Milwaukee and The State of Wisconsin Department of Transportation for the purpose of delegating responsibilities for maintenance for a green infrastructure project in an area around the I-43/94 bridge over West Becher Street.
Body
Whereas, The City of Milwaukee and the Milwaukee Metropolitan Sewerage District (MMSD) are entering in to an intergovernmental cooperation agreement (ICA) outlining the shared responsibilities for constructing a green infrastructure project at the subject location; and

Whereas, Per the terms of the ICA between the City of Milwaukee and the MMSD, the City is obligated to abide by the terms of a maintenance covenant for the green infrastructure project for a period of 10 years; and

Whereas, The Wisconsin Department of Transportation (WisDOT) owns the land on which the green infrastructure project is being constructed; and

Whereas, WisDOT desires to participate in the green infrastructure project by permitting said work; and

Whereas, WisDOT further agrees to contribute up to $150,000 over a 10-year period towards the City’s maintenance efforts; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are authorized and directed to prepare and execute the State/Municipal Maintenance Agreement between the City of Milwaukee and the State of Wisconsin Department of Transportation in substantially the same form as attached to this file, for the purpose of delegating responsibilities for a green infrastructure project in the area ...
